New York Landscape Architect seal requirements: proper sizing, signing and sealing of documents

As of

New York specifies the seal in the Commissioner's regulations: 8 NYCRR § 79-1.4(a) requires a circular seal approximately 1 3/4 inches in diameter, with "Registered Landscape Architect" at the top of the outer band and "State of New York" at the bottom, and, in the inner circle, the licensee's name above the Great Seal of New York and the license number below it, "with no other letters or numbers." Education Law § 7327(1) requires working drawings and specifications to be stamped with the seal and signed on the original with the licensee's personal signature when filed with public officials. New York additionally requires an alteration-warning stamp on every sealed plan, specification and report.

New York requires something almost no other state does: a separate alteration-warning stamp alongside the seal. Documents filed with public officials also need a personal signature on the original. Section 79-1.4 has two subdivisions, lettered (a) and (b); paragraph numbers in Subpart 79-1 sit one level below the letter, as the Subpart's own cross-references to "section 79-1.1(b)(1)" show. By its own terms, § 79-1.4(a) prescribes this design for applicants who initially applied for licensure on or after January 1, 1987; the regulation does not describe the design used by earlier licensees. Article 148 was read at https://www.op.nysed.gov/professions/landscape-architecture/laws-rules-regulations/article-148 and the subdivision numbering of Educ. Law § 7327 at https://www.nysenate.gov/legislation/laws/EDN/7327.

New York Landscape Architect seal

Legend
“Registered Landscape Architect, State of New York”
Diameter
Circular, approximately 1 3/4 inches in diameter.
Expiration date
The regulation enumerates the entire contents of the seal — the two legends, the Great Seal of New York, the licensee's name and the license number — and closes the list with "with no other letters or numbers," which leaves no room for an expiration date. A New York license is in any event "valid during the life of the holder unless revoked, annulled or suspended by the board of regents."(8 NYCRR § 79-1.4(a); N.Y. Educ. Law § 6502(1))
Signature date
Section 7327(1) requires the personal signature on the original when filed with public officials but prescribes no date; the only date required by the seal rules is the date of an alteration under 79-1.4(b).(N.Y. Educ. Law § 7327(1); 8 NYCRR § 79-1.4(b))
City on seal
The only place wording prescribed is "State of New York" at the bottom of the outer band, and the rule bars any other letters or numbers.(8 NYCRR § 79-1.4(a))
  • For those applicants initially applying for licensure on or after the effective date of this Part (January 1, 1987), seals used by licensed landscape architects shall be circular in shape, approximately 1 3/4 inches in diameter, bearing the legend at the top of the outer band, "Registered Landscape Architect" and at the bottom "State of New York." In the inner circle above the Great Seal of New York shall be shown the name of the licensee, and below the Great Seal the license number with no other letters or numbers.(8 NYCRR § 79-1.4(a))
  • Every landscape architect shall have a seal, approved by the board, which shall contain the name of the landscape architect and either the words "Registered Landscape Architect" and such other words or figures as the board may deem necessary.(N.Y. Educ. Law § 7327(1))
  • All working drawings and specifications prepared by such landscape architect relating to the setting, approaches or environment for structures or other improvements or under the supervision of such landscape architect, shall be stamped with such seal and signed on the original, with the personal signature of such landscape architect when filed with public officials, or with the official seal and personal signature of a landscape architect granted a limited permit under section seventy-three hundred twenty-five of this article when such drawings and specifications are accompanied by a written authorization from the department for the specific project concerned.(N.Y. Educ. Law § 7327(1))
  • To all plans, specifications and reports to which the seal of a landscape architect has been applied, there shall also be applied a stamp with appropriate wording warning that it is a violation of the law for any person, unless acting under the direction of a licensed landscape architect, to alter an item in any way.(8 NYCRR § 79-1.4(b))
  • If an item bearing the seal of a landscape architect is altered, the altering landscape architect shall affix to his item the seal and the notation "altered by" followed by his signature and the date of such alteration, and a specific description of the alteration.(8 NYCRR § 79-1.4(b))
  • It shall be lawful for a corporation organized and existing under the laws of the state of New York, and which on or before the first day of April nineteen hundred sixty-one was legally incorporated to practice landscape architecture ... to continue such practice provided ... that such plans and designs shall be prepared under the personal direction and supervision of such landscape architect and bear the stamp of his official seal, and such drawings or specifications shall also be signed on the original, with the personal signature of such landscape architect.(N.Y. Educ. Law § 7327(4))

New York landscape architect seal questions

Is the Great Seal of New York in the inner circle, with the name above and number below?

Does the seal carry the Great Seal of New York in the inner circle? The licensee's name goes above it and the license number below it, and the rule forbids any other letters or numbers in the design. (8 NYCRR § 79-1.4(a))

Is the alteration-warning stamp applied alongside the seal?

Have you added the separate alteration-warning stamp? New York requires a second stamp, warning that altering the item is a violation of law, on every plan, specification and report to which the landscape architect's seal is applied. (8 NYCRR § 79-1.4(b))

Registered or licensed — which word belongs on a New York seal?

The legend reads "Registered Landscape Architect" even though Article 148 speaks of licensure; the design does not use the word "licensed." (8 NYCRR § 79-1.4(a); N.Y. Educ. Law § 7327(1))
