Rhode Island Landscape Architect seal requirements: proper sizing, signing and sealing of documents

Rhode Island defines the seal in the Board's own regulation: 420-RICR-00-00-1 § 1.4(R) requires an embossed circular seal or rubber stamp carrying the landscape architect's name, the registration number, the word "Registered" above the State's emblem and the words "Landscape Architect" below the registration number. The design and size are whatever the Board approves — no diameter is stated — and § 5-51-11(a)(3) has the Board furnish a copy of the authorized seal from which the registrant has one made. Under § 1.9(B) the seal is applied and then signed and dated, and § 5-51-13(b)(3) requires all final drawings and documents to be dated and to bear the signature and seal.

The seal statute is R.I. Gen. Laws § 5-8-14, "Certificates of registration — Enrollment cards — Seals." § 5-8-11 (qualifications for registration) and § 5-8-12 are frequently cited in its place and govern nothing about the stamp. The engineering rule was amended effective 03/07/2024. The regulation is 420-RICR-00-00-1, filed as an amendment effective May 1, 2023. The Board sits within the Rhode Island Department of Business Regulation and is administered through the Division of Design Professionals.

Who decides the size?

The Board does. § 1.4(R) approves both design and size, and § 5-51-11(a)(3) has the Board furnish a copy of the authorized seal from which the applicant has a seal and stamp made — so the design comes from the Board rather than from a dimension in the rule. Is an electronic seal alone enough?
