North Dakota Landscape Architect seal requirements: proper sizing, signing and sealing of documents

North Dakota registers landscape architects under the same chapter as architects, and the stamp rule is N.D. Admin. Code ch. 8-06-01, adopted under the delegation in N.D. Cent. Code § 43-03-22. The stamp is no less than one and one-half and no more than two inches in diameter and carries the licensee's name, licence number, a date line reading "DATE:__/__/____" and the words "LICENSED LANDSCAPE ARCHITECT - STATE OF NORTH DAKOTA". A rubber stamp, an embosser or a digital image are all permitted formats, but § 8-06-01-03(5) requires the licensee's original signature and the date of signing across each imprint, and a document carrying a digital stamp, signature and date must have a wet signature and date written over them when it is submitted for building permitting.

Two boards, two rules and two seals that look nothing alike. Engineers and land surveyors are registered by the North Dakota State Board of Registration for Professional Engineers and Land Surveyors under N.D. Admin. Code ch. 28-02.1-08; architects and landscape architects are licensed by the North Dakota State Board of Architecture and Landscape Architecture under ch. 8-06-01. The statute and the rule state the engineering legend differently: N.D.C.C. § 43-19.1-21 gives it in lower case as "registered professional engineer" or "registered professional land surveyor" and offers no combined form, while the board's seal design rule capitalizes the phrases and adds "Registered Professional Engineer & Land Surveyor" for dual registrants. The rule governs the design of the seal, so its capitalization and its combined form are what a seal should follow. Section 28-02.1-08-02 was last amended effective October 1, 2021 and § 28-02.1-08-03 effective January 1, 2024. Section 8-06-01-02 also reproduces an older North Dakota-outline certification stamp and states that the stamp adopted by the board in its earlier "rules and regulations dated __________" - the date is left blank in the published chapter - "will be accepted for persons licensed prior to the effective date of those rules". The round design set out in § 8-06-01-02(1) is the one the current chapter prescribes; the History lines for §§ 8-06-01-02 and 8-06-01-03 give their effective date as January 1, 2014.

Signature date
The date is both part of the stamp design and separately required at signing. Section 8-06-01-02(1) puts the word "DATE:__/__/____" inside the stamp, and § 8-06-01-03(5) says what goes on that line: "The original signature of the licensed architect or landscape architect named on the stamp shall appear across the face of each original stamp imprint, along with the date of signing." The signature may be digital or wet, and the illustrations printed in § 8-06-01-03 show it written across the face of the stamp with the date on the line.(N.D. Admin.   • At the time of the issuance of the certificate of registration, the board shall require the certificate holder to acquire, at the certificate holder's expense, a stamp or indicia to be used by the certificate holder in the conduct of the certificate holder's practice and to be impressed upon drawings, plans, and other documents prepared by the certificate holder. The board shall adopt rules governing the technical requirements of such stamp and indicia and the certificate holder's signature.(N.D. Cent. Code § 43-03-22; N.D. Admin. Code § 8-06-01-01)
  • Each licensed architect's or landscape architect's stamp shall be no less than one and one-half inches and no more than two inches in diameter. It shall contain the name of the licensed architect or landscape architect; the individual's license number, the word "DATE:__/__/____" and the words "LICENSED ARCHITECT - STATE OF NORTH DAKOTA" or "LICENSED LANDSCAPE ARCHITECT - STATE OF NORTH DAKOTA" as appropriate.(N.D. This signature may be either digital or wet. North Dakota landscape architect seal questions

Can a landscape architect use the architect's North Dakota stamp wording?

No. Section 8-06-01-02(1) gives the two professions different legends and requires "LICENSED LANDSCAPE ARCHITECT - STATE OF NORTH DAKOTA" for the landscape architect "as appropriate". The diameter range and the date line are the same for both. (N.D. Admin. Code § 8-06-01-02(1))

A digital stamp is allowed - is a digital signature enough for a building permit?

No. Section 8-06-01-03(5) lets the signature across the stamp be either digital or wet, but adds that "Documents with digital stamp, signature, and date that are submitted for building permitting shall have a wet signature and date written over the digital stamp, signature, and date", for any project or building type whether exempt or not. The chapter's own illustrations show a wet signature and date inked over a digital imprint, so the permit set has to be signed by hand. (N.D. Admin. Code § 8-06-01-03(5))

Does an exempt building type let the landscape architect skip the stamp?

No. Section 8-06-01-03(1) requires the stamp on all documents used for construction or technical submissions "whether the project or building type is exempt or not exempt under North Dakota statutes", and § 8-06-01-03(5) applies the wet-signature-for-permitting rule to exempt and non-exempt work alike. Is an unsigned stamp imprint worth anything?

No. Under § 8-06-01-03(6) the stamp is prima facie evidence that the work was prepared by or under the responsible control of the person named on it "only if the stamp has been signed and dated". (N.D. Admin. Code § 8-06-01-03(6))
