Michigan Landscape Architect seal requirements: proper sizing, signing and sealing of documents

Michigan fixes the seal's wording in both statute and rule. MCL 339.2210(1) requires each landscape architect to have a seal containing the licensee's name, license number and the legend "landscape architect, state of Michigan", while Mich. Admin. Code R. 339.19041(1), amended effective 4/26/2021, requires the seal to state the licensee's name and landscape architect license number and to bear the words "licensed landscape architect" and "state of Michigan". The rule supplies a design figure but no diameter appears in either the statute or the rule.

The rule fixes the wording and the layout by reference to Figure 32 but says nothing about diameter. MCL 339.2210(1) still speaks of a seal "approved by the department and the board", but the Board of Landscape Architects was abolished and its powers transferred to the department by Executive Reorganization Order No. 2007-17, compiled at MCL 445.2023; licensing is now administered by LARA's Bureau of Professional Licensing. R 339.19041 was amended by the rule set filed with the Secretary of State on April 26, 2021, which replaced the former "registered landscape architect" design with the "licensed landscape architect" design. A later rule set (2022-023) rescinded R 339.19004 to R 339.19018 and added R 339.19011 and others, but left R 339.19041 untouched.

Michigan landscape architect seal questions

Does the seal say "landscape architect" or "licensed landscape architect"?

The statute and the rule do not read the same way. MCL 339.2210(1) prescribes the legend "landscape architect, state of Michigan", while R 339.19041(1), as amended effective 4/26/2021, requires the words "licensed landscape architect" and "state of Michigan", and the design figure in R 339.19041(2) reads LICENSED LANDSCAPE ARCHITECT. The statute permits "other words or figures as the department considers necessary", which is the authority under which the department's figure adds "licensed". (MCL 339.2210(1); Mich. Admin. Do you have to send an imprint to the state?

Yes, and on a deadline. R 339.19041(3) requires the licensee to obtain the seal on licensure and submit an imprint to the department within 30 days of licensure, and to submit a new imprint within 30 days if a new seal is obtained later. (Mich. Admin. Code R. 339.19041(3))
